NexaSync is operated by MAD OVER TECHNOLOGY, a sole proprietorship with its business address at Second Floor, Plot No-21, Panchsheel Park, G.T. Road, Sahibabad, Ghaziabad, Uttar Pradesh, 201005, India ("we", "us" or "our"). This Privacy Policy covers nexasync.io, portal.nexasync.io and the NexaSync applications and services. Personal information means information relating to an identifiable individual, including account contact details and employee information.
We use account information to operate, secure and support NexaSync and administer our customer relationship. For employee information submitted by an employer, we process information on that employer’s instructions to provide the service. The employer is responsible for appropriate employee notices and a lawful basis for that processing, including consent where required. Employees should contact their employer about its workplace-monitoring practices and may contact us at hello@madovertech.io about NexaSync’s handling of their information.
Reading this policy or visiting the website does not by itself give consent to optional marketing, customer-logo publicity or every possible use of personal information. We request separate consent where applicable and explain how it can be withdrawn. Security measures reduce risk but cannot guarantee absolute security.
2. Information we collect and how we use it
We collect, receive and store your company information. You may opt to not provide us with certain information; however that will restrict you from registering with us or availing some of our features and services. We use commercially reasonable efforts to ensure that the collection of information is limited to that which is necessary to fulfill the purposes identified below.
If we use or plan to use your information in a manner different than the purpose for which it is collected, then we will ask you for your consent prior to such use. The information collected will be used only for the purpose of enabling you to use the services provided by us, to help promote a safe service, calibrate consumer interest in our products and services, inform you about online offers and updates, troubleshoot problems, customize User experience, detect and protect us against error, fraud and other criminal activity, enforce our terms and conditions, and as otherwise described to you at the time of collection of such information.
3. Account information
When you register, we collect your name, email address, phone number, password and company name to create, authenticate, secure and support your account and provide the requested service. We also record agreement acknowledgements and optional permission choices, including the wording or version, time, company, IP address and browser details, to administer the agreement and keep evidence of those choices.
Customer accounts may contain employee information such as names, contact details, attendance, photographs and location data, depending on the features used. We process that information to provide the employer’s configured service. The employer must explain its monitoring practices to employees and establish a lawful basis; its administrator’s signup does not itself give consent on behalf of employees.
We send account verification, security, billing and other service-related communications needed to operate the account. Accepting service terms or acknowledging this policy does not subscribe you to optional promotional communications. Where consent is required, we seek a separate choice. Promotional communications can be stopped using their unsubscribe facility or by contacting hello@madovertech.io. Company-logo publicity is a separate permission described in section 5.
We do not sell personal information. Account and service data are subject to the retention periods stated in the Terms of Use and applicable legal obligations. We may retain limited records where necessary to meet legal requirements, resolve disputes or demonstrate past agreement and permission choices.
4. Data Breach Procedure and Reporting Time Period
In the event of a data breach, we adhere to a strict protocol to promptly mitigate and address the situation. Our response involves identifying the breach, containing its effects, assessing the impacted data, notifying the appropriate authorities, and maintaining transparent communication with those affected.
We conduct thorough investigations to determine the breach's extent and implement corrective actions to prevent future occurrences. Any identified data breach will be reported to the relevant authorities and affected individuals within 72 hours of discovery, in accordance with applicable data protection regulations.
5. Consent and optional permissions
We distinguish acceptance of the service agreement, acknowledgement of this privacy notice, and optional permissions. Where processing relies on consent, we explain the purpose and seek an affirmative choice. You may withdraw consent by emailing hello@madovertech.io. Withdrawal does not affect processing lawfully carried out before withdrawal. If withdrawn consent is necessary for a requested feature, we will explain the effect on that feature; declining an unrelated optional permission does not prevent use of the service.
Company-name and logo publicity is optional and is not enabled merely by registering, paying for NexaSync, uploading a logo to the account or accepting service terms. An authorised company representative can separately permit MAD OVER TECHNOLOGY to identify the company as a customer on NexaSync websites, social media, presentations and marketing materials, including advertisements. The non-exclusive, royalty-free permission, brand-guideline safeguards and restrictions on endorsement, employee data, testimonials and case studies are described in section 2.1 of the Service Agreement.
To withdraw company-name and logo permission, email hello@madovertech.io from your registered business email and identify the company. We will stop future use and remove the name and logo from materials under our control within 30 days. We may reasonably verify your authority before acting. Declining or withdrawing this permission does not affect service access.
6. Data Subject Rights
We are committed to upholding your rights as a data subject under applicable data protection laws. You have the right to access, correct, or delete your personal data held by us. Additionally, you may request the restriction of processing, object to certain types of processing, and request data portability where applicable.
We also provide the right to withdraw consent at any time and the right to lodge a complaint with a supervisory authority. To exercise these rights, please contact the data protection officer, and we will respond promptly to your request, ensuring your privacy and data protection rights are respected.

7. Feedback
If you contact us to provide feedback, register a complaint, or ask a question, we will record any Personal Information and other content that you provide in your communication so that we can effectively respond to your communication.
8. Activity
We record information relating to your use of NexaSync, such as the searches you undertake, the pages you view, your browser type, IP address, location, requested URL, referring URL, and timestamp information. We use this type of information to administer NexaSync and provide the highest possible level of security and service to you.
We also use this information in the aggregate to perform statistical analyses of User behavior and characteristics in order to measure interest in and use of the various areas of NexaSync. However, you cannot be identified from this aggregate information.
9. Cookies
We send cookies to your computer in order to uniquely identify your browser and improve the quality of our service. The term "cookies" refers to small pieces of information that a website sends to your computer's hard drive while you are viewing the site.
We may use both session cookies (which expire once you close your browser) and persistent cookies (which stay on your computer until you delete them). Persistent cookies can be removed by following your browser help file directions. If you choose to disable cookies, some areas of NexaSync may not work properly or at all.
10. Enforcement
We may use the information we collect in connection with your use of NexaSync (including your Personal Information) in order to investigate, enforce, and apply our terms and conditions and Privacy Policy.
11. Transfer of information
We do not share your Personal Information with any third party apart from regulatory agencies (as may be required) and to provide you with services that we offer through NexaSync, conduct quality assurance testing, facilitate creation of accounts, provide technical and customer support, or provide specific services, such as synchronization of your contacts with other software applications, in accordance with your instructions.
These third parties are required not to use your Personal Information other than to provide the services requested by you. We may share your Personal Information with our parent company, subsidiaries, joint ventures, or other companies under a common control (collectively, the "AFFILIATES") that we may have now or in the future, in which case we will require them to honor this Privacy Policy.
12. Security
Your account is password protected. We use industry standard measures to protect the Personal Information that is stored in our database. We limit the access to your Personal Information to those employees and contractors who need access to perform their job function, such as our customer service personnel.

You hereby acknowledge that Mad Over Technology is not responsible for any intercepted information sent via the internet, and you hereby release us from any and all claims arising out of or related to the use of intercepted information in any unauthorized manner.
13. Updates to this Privacy Policy
We will display the date of the latest revision on this page. Material changes to the handling of existing account information will be communicated through an account notice or the registered email address before taking effect, unless an earlier change is required by law or necessary to address an urgent security issue. Please keep your account contact details current.
If a new or changed purpose requires consent, we will request that consent before using information for that purpose. A policy update or continued service use does not create optional marketing or customer-logo permission or remove the right to withdraw consent. 14. Applicable law
Your use of this Website will be governed by and construed in accordance with the laws of India. The Users agree that any legal action or proceedings arising out of your use may be brought exclusively in the competent courts/tribunals having jurisdiction in Gurgaon in India and irrevocably submit themselves to the jurisdiction of such courts/tribunals.
